Terms of use

These terms govern the use of the ark.fit iOS application and the fit.ark.swiss website, published by ark.swiss Sàrl, Lausanne (Switzerland). By installing or using ark.fit, you accept them.

1. What ark.fit is — and what it is not

ark.fit is a wellness tool: calorie tracking whose daily base budget stays stable. An estimated goal date appears and adjusts only with a reliable weight trend; otherwise it remains unavailable, without automatically reducing that budget. It is not a medical device; the app provides no diagnosis, medical advice or treatment, and its estimates (budget, goal date, ranges, AI estimates) remain estimates.

Consult a health professional before any weight-loss goal. Do not use ark.fit if you are under 18 or in case of an eating disorder — the app is not designed for those situations. During pregnancy and breastfeeding, use the dedicated tracking mode (never a deficit during pregnancy) and follow your health professional’s advice.

2. Safeguards — and their limits

The app applies safeguards (calorie floor, deficit cap, forced budget increase when weight loss is too fast, recalculation freeze when the log is incomplete). They reduce the risks of inappropriate use but replace neither your judgement nor medical advice.

3. Pricing: free app, pay-as-you-go AI

The core of the app is free, with no subscription. The AI features (photo estimation, recipe ideas, AI Insights) use prepaid credits purchased in the app (Apple in-app purchase):

• credits are prepaid, with no auto-renewal — never a surprise charge;
• usage is counted at real cost, with the balance visible in the app;
• no credit = no charge: the AI features simply pause;
• in-app purchases are subject to Apple’s terms; credits have no monetary value outside the app and are not transferable.

4. Your account and your data

The core of the app works without an account. Server features require signing in with Sign in with Apple (opaque identifier, no name or e-mail). Your tracking data stays on your device; the privacy policy covers everything in detail.

You remain responsible for the accuracy of what you enter (weight, meals): the adaptive engine computes from your data.

5. Acceptable use

You agree not to: circumvent or overload the services (including the AI quotas), attempt to access other people’s systems, decompile the app beyond what the law allows, or use the AI features to submit unlawful content.

6. Intellectual property

The app, the website, the ark.fit brand and their contents belong to ark.swiss Sàrl. Official food data comes from the FSVO/BLV database (Swiss Confederation) and European references; it remains subject to their respective terms.

7. Availability and evolution

We keep improving the app and may modify, suspend or discontinue features (in particular server and AI features). The app is provided “as is”; to the extent permitted by applicable law, our liability is limited to direct damage caused by gross negligence or intent. Nothing in these terms excludes liability that cannot legally be excluded.

8. Governing law and jurisdiction

These terms are governed by Swiss law. The exclusive place of jurisdiction is Lausanne (Switzerland), subject to mandatory provisions to the contrary.
